Are IHSS Providers Eligible for Paid Sick Leave?

Yes. As of July 1, 2018, IHSS providers can earn paid sick leave if they are active IHSS provider that works for an IHSS/WPCS recipient.

To earn sick leave, you must complete a one-time, two-part requirement to earn and use paid sick leave:

  • Work 100 hours for an IHSS recipient to earn paid sick leave hours; and
  • Wait 60 days or work an additional 200 hours, whichever comes first, before using paid sick leave hours.

How does IHSS Timesheet work in Los Angeles County?

IHSS providers and recipients in Los Angeles County have two options regarding timesheets.

They can either enroll in the Electronic Timesheet System (ETS) or the Telephonic Timesheet System (TTS) to complete, submit, and manage their IHSS timesheet and payment accounts.

These systems allow IHSS providers to submit their IHSS timesheets and the IHSS recipients to review, reject, or approve timesheets using a computer, laptop, tablet, smartphone, and/or by phone.

Is there Overtime Pay for IHSS Providers in Los Angeles?

Yes. IHSS Providers in Los Angeles County can be paid for overtime if approved. Here’s how it works:

IHSS Providers in Los Angeles County can receive payment for:

  • Hours worked over 40 hours in a workweek as overtime (OT);
  • Wait time at medical appointments under certain conditions;
  • The time needed for traveling directly from one recipient to another on the same day, up to seven hours per workweek; and
  • Attending mandatory State training after you start working.

However, a provider cannot work for more than 66 hours per workweek unless granted an exemption.

Additionally, an IHSS provider can work up to a maximum of 90 hours per workweek, if granted an exemption.

Also, it is important to note that the IHSS provider will receive a violation whenever the maximum workweek limits for OT or travel time are exceeded.

To avoid receiving a violation note, it is important to stay within the overtime rules outlined above.

What Services are Approved under IHSS?

Approved IHSS services in Los Angeles County include the following:

  • Domestic services
  • Heavy cleaning
  • Meal preparation and clean-up
  • Restaurant allowance
  • Routine laundry
  • Ironing and mending
  • Reasonable shopping and errands
  • Non-medical personal services
  • Transportation assistance
  • Yard hazard abatement
  • Protective assistance
  • Teaching and demonstration services
  • Paramedical services.

Can a family member be an IHSS provider?

Yes. You can hire relatives, friends, neighbors, and other caregivers to provide you with IHSS.

However, it can be tricky to be the paid IHSS care provider to a family member or
close friend.

As the provider, you are an employee of that person, working in a program that has a lot of rules.

Therefore, understanding your responsibilities as a provider to someone you already know is vital to success when you are
“wearing two hats.”

How are IHSS Payments Made in Los Angeles?

There are two ways in which IHSS payments are made: Advanced and arrears.

Advanced pay is a payment option available only to IHSS consumers with severe disabilities.

Under this option, a check is mailed directly to the IHSS consumer at the beginning of each month and they pay the IHSS provider(s).

The arrears option is that in which payment is made directly to the IHSS provider(s) on a bi-weekly basis.
